LIMITED WARRANTY

1 Year Functional Operation

The Modtub and its various core components (including the tub, chiller, pump, filter, GFCI protected power cord, hoses & filters) are warrantied against any manufacturer defect in materials or workmanship under normal use and service for a period of one (1) year from the original date of purchase (not the date of delivery).

During the warranty period, if the Modtub experiences issues with any covered component that impairs normal functional operation, the owner should notify Modtub as soon as possible using the contact information listed in the section entitled “Requesting Service.” If requested, the customer may be required to return the damaged component to Modtub for inspection. Modtub will cover the cost of return shipping.

Services

To receive services under this warranty, the owner must present proof of purchase of their product to Modtub at the time of notification. Modtub will determine whether the claim is covered under the terms of this Limited Warranty and whether a troubleshooting session is needed. If applicable, Modtub will provide a replacement product or component, together with instructional support if requested. Modtub does not cover labor or installation costs. This warranty is non-transferable.

Shipping Damage Policy

All Modtub products are carefully inspected and packaged before shipment. Upon delivery, customers must inspect their product carefully.

• If there is visible damage at the time of delivery, the delivery must be refused, and Modtub should be contacted immediately.
  
  
• If damage is discovered after delivery has been accepted, the customer must notify Modtub within three (3) days of delivery, including photographs of the damage, packaging, and shipping label.
  
  

Failure to report shipping damage within this timeframe may result in the damage not being covered.

Component Disclaimers

Tub.

The rotomolded tub included with the Modtub is covered by the 1-year functional operation warranty above. However, blemishes (including dents, warping, scuffs, scratches, discoloration, fading, non-sticking graphics, or wear to skid pads) are not covered under this warranty. Additionally, exposure to direct sunlight can cause warping and material damage and will void this warranty.

Chiller.

The chiller included with the Modtub is covered by the 1-year functional operation warranty above. However, damage to the chiller caused by freezing conditions, improper maintenance, improper water chemistry, or owner negligence is not covered under this warranty.

Pump.

The pump assembly (including the pump, impeller, and pump cover) included with the Modtub is covered by the 1-year functional operation warranty above. However, damage to the pump assembly or any component thereof caused by freezing conditions, improper maintenance, improper water chemistry, or owner negligence is not covered under this warranty.

Plumbing.

The hoses and fittings included with the Modtub are covered by the 1-year functional operation warranty above. However, damage to the plumbing caused by freezing conditions, improper maintenance, improper water chemistry, or owner negligence is not covered under this warranty.

GFCI Protected Power Cord.

The GFCI protected power cord included with the Modtub is covered by the 1-year functional operation warranty above. However, damage caused by exposure to water or improper electrical connections is not covered. The power cord must be plugged into a properly grounded outlet located at least 5 feet away from the Modtub or any electrical components, in accordance with safety guidelines.

Other Components.

All other components included with the Modtub are covered by the 1-year functional operation warranty above. However, damage to these components caused by freezing conditions, improper maintenance, improper water chemistry, or owner negligence is not covered under this warranty.

Specific Conditions

This 1-year warranty shall no longer be valid if the Modtub and/or its components are:

1. Damaged through abuse, misuse, negligence, or improper maintenance;
   
   
2. Damaged in an accident;
   
   
3. Unreasonably used or used for any purpose for which it was not intended;
   
   
4. Repaired or altered in a way that affects performance or safety;
   
   
5. Damaged due to any act of nature; or
   
   
6. Left exposed in direct sunlight for extended periods. Fading, warping, or cracking from UV exposure will void this warranty.
   
   

The Modtub must be set up on a level, sturdy surface capable of supporting the weight of the tub, water, and occupant(s), and in accordance with all safety guidelines and precautions outlined in the user manual. Improper installation may void this warranty.

Proof of Purchase

The owner must present sufficient proof of purchase to Modtub to obtain warranty service.

Limitations on Implied Warranties

This Limited Warranty replaces all other express or implied warranties to the maximum extent permitted by law. Nothing in this warranty restricts your right to maintain or repair your Modtub on your own, but Modtub is not responsible for any damage that occurs as a result of unauthorized modifications or improper repairs.

General Disclaimers

Modtub, LLC shall not be liable for any injuries, losses, costs, or other damages, whether incidental or consequential, arising out of any defective product or component covered by this Limited Warranty, including the loss of use of the Modtub and/or cost of removal of a defective product. The liability of Modtub, LLC, if any, shall not exceed the original purchase price of the product or component.
